Acceptable Use
Policy

1.1 This Acceptable Use Policy (“AUP”) sets out the rules governing acceptable and prohibited use of the Wishew Platform, including Content, Goals, Journeys, Updates, the Funds Function, Support Payments and other Platform functionality.

1.2 This AUP forms part of and should be read together with the Wishew Terms and Conditions of Use (“Terms”). Capitalised terms not defined in this AUP have the meanings given to them in the Terms.

1.3 This AUP applies to all Users and all activity conducted through or in connection with the Platform. Users must comply with this AUP and all applicable laws and regulations.

1.4 Some restrictions in this AUP apply specifically to the Funds Function and Support Payments. Unless expressly stated otherwise, those restrictions do not prevent Users from using Wishew's ordinary social functionality for otherwise lawful and permitted Content.

2.1 Users may use Wishew only for lawful purposes and in accordance with the Terms and this AUP.

2.2 Goals using the Funds Function must relate to genuine personal Goals, projects, milestones or experiences.

2.3 Users must provide accurate, truthful, complete and non-misleading information regarding:

• their identity;
• their Goal;
• the intended beneficiary;
• the purpose for which Support Payments are requested; and
• information reasonably requested by Wishew for verification, compliance, fraud prevention or risk-management purposes.

2.4 Unless expressly approved by Wishew, the Wisher must be the intended beneficiary of Support Payments associated with their Goal. Users must not use Wishew to collect, receive, transmit or distribute funds on behalf of unrelated third parties.

2.5 Support Payments must be voluntary. They must not be offered, requested or accepted in exchange for goods, services, securities, repayment rights, financial returns, rewards, exclusive Content or other prohibited consideration.

3.1 Wishew must not be used to create, publish, promote, facilitate, finance or otherwise support any activity or Content that is illegal, fraudulent or unlawful in an applicable jurisdiction. This includes, without limitation:

• fraud, scams and deceptive schemes;
• money laundering;
• terrorist financing;
• sanctions evasion;
• tax evasion;
• bribery and corruption;
• identity theft or identity fraud;
• trafficking or exploitation of persons;
• organised criminal activity;
• theft, stolen property or proceeds of crime;
• counterfeit or unlawfully obtained goods;
• fraudulent or falsified documents;
• cybercrime, malware or malicious hacking;
• unlawful surveillance;
• unlawful violence or threats of violence;
• illegal adult or sexually explicit Content or services;
• child sexual abuse material (CSAM) or any sexual exploitation or abuse of minors;
• non-consensual intimate or sexually explicit Content;
• sexual exploitation, trafficking or coercion;
• prostitution, sexual services or related activity where unlawful;
• illegal drugs or unlawfully distributed controlled substances;
• illegal weapons, explosives or other prohibited dangerous goods;
• unlawful gambling, lotteries or betting;
• unlawful financial or investment activities; and
• attempts to circumvent applicable laws, sanctions, regulatory requirements or financial controls.

3.2 Users must not use false, misleading, fraudulent or materially incomplete information to:

• create or operate a Goal;
• obtain Support Payments;
• access the Funds Function;
• complete identity or compliance verification;
• conceal the true beneficiary of Support Payments; or
• circumvent Platform controls.

3.3 Users must not use Wishew to solicit, receive, transfer or otherwise facilitate proceeds derived from illegal or fraudulent activity.

3.4 Where Wishew reasonably suspects illegal or fraudulent activity, Wishew may restrict or suspend the relevant Content, Goal, Funds Function, Support Payments, withdrawals or Account while the matter is reviewed and may report the activity to competent authorities where required or permitted by law.

4.1 Wishew prohibits Content, Goals and Support Payments that promote, finance, praise, facilitate or materially support:

• terrorism;
• terrorist organisations;
• violent extremist organisations;
• recruitment into terrorist or violent extremist organisations;
• extremist violence;
• unlawful acts of violence; or
• terrorist or violent extremist propaganda.

4.2 Users must not make, request or receive Support Payments for the direct or indirect benefit of terrorist or violent extremist persons, organisations or activities.

4.3 Content that promotes, incites or encourages unlawful violence or physical harm against individuals or groups is prohibited.

4.4 Users must not use Wishew to promote unlawful hatred, harassment or discrimination against individuals or groups based on protected characteristics under applicable law.

5.1 Users must not use Wishew in violation of applicable economic, financial or trade sanctions.

5.2 Users must not knowingly make, request, receive or facilitate Support Payments for the direct or indirect benefit of:

• sanctioned persons;
• sanctioned entities or organisations;
• prohibited jurisdictions; or
• other persons or entities with whom transactions are prohibited by applicable law.

5.3 Wishew may restrict or prohibit access to the Platform, Funds Function, Support Payments or withdrawals based on geographic availability, sanctions requirements, regulatory requirements or financial-crime risk.

5.4 Geographic restrictions may be modified where necessary to reflect changes in applicable law, sanctions regimes or Wishew's risk controls.

6.1 Wishew must not be used to provide or facilitate unauthorised or prohibited financial services. Users must not use the Platform for:

• peer-to-peer money transmission;
• remittances;
• transferring money between unrelated persons;
• payment processing on behalf of third parties;
• stored-value services;
• digital wallets;
• currency exchange;
• cash advances;
• bill payment services; or
• other regulated payment or financial services unless expressly approved by Wishew.

6.2 Users must not disguise a financial transaction as a Goal or Support Payment to circumvent Platform controls.

6.3 The Funds Function is intended solely to allow an eligible Wisher to receive voluntary Support Payments in connection with their own permitted Goal and must not be used as a general-purpose payment or money-transfer service.

7.1 The Funds Function must not be used for:

• equity crowdfunding;
• securities offerings;
• investment opportunities;
• loans;
• peer-to-peer lending;
• debt instruments;
• investment funds;
• financial derivatives;
• schemes promising financial appreciation or returns; or
• other arrangements through which a Supporter expects repayment or financial gain.

7.2 Support Payments must not provide a Supporter with:

• equity;
• ownership;
• repayment rights;
• interest;
• profit participation;
• dividends; or
• any other financial return.

8.1 Unless expressly approved by Wishew, Users must not use the Platform or Funds Function to:

• buy or sell cryptocurrency or other digital assets;
• exchange fiat currency for digital assets or vice versa;
• issue or sell tokens;
• conduct token offerings;
• fund cryptocurrency trading or speculation;
• provide cryptocurrency investment services;
• operate cryptocurrency wallets or exchanges; or
• facilitate regulated or prohibited digital-asset activity.

8.2 Users must not disguise cryptocurrency or digital-asset transactions as personal Goals or Support Payments.

9.1 Wishew must not be used for:

• gambling;
• betting;
• casino activity;
• lotteries;
• raffles;
• paid-entry sweepstakes;
• games of chance involving monetary prizes; or
• other gambling or prize-based activities requiring regulatory authorisation.

9.2 Payments for participation in gambling, lotteries, raffles or similar activities must not be presented or processed as Support Payments.

10.1 Wishew does not permit the Platform, Goals, Content, Funds Function or Support Payments to be used for or in connection with:

• pornography or pornographic Content;
• sexually explicit Content;
• sexual services;
• prostitution;
• escort services involving or promoting sexual services;
• adult live-streaming, webcam or adult chat services;
• sexual exploitation or trafficking;
• non-consensual intimate or sexually explicit Content;
• Content depicting or promoting sexual violence;
• the sexual exploitation or abuse of any person;
• child sexual abuse material (CSAM);
• sexual Content involving minors; or
• fundraising connected with prohibited adult Content, products or services.

10.2 Any Content or activity involving the sexual exploitation or abuse of minors is strictly prohibited, regardless of whether a Support Payment or the Funds Function is involved. Wishew may immediately remove such Content, suspend or terminate the relevant Account, restrict associated transactions and report the matter to competent authorities where required or permitted by law.

10.3 The fact that particular adult Content or services may be lawful in a User's jurisdiction does not mean that they are permitted on Wishew. Wishew may prohibit categories of adult or sexual Content, services or fundraising as a matter of Platform policy and risk management.

11.1 Users must not use the Platform or Funds Function to fund, purchase, manufacture, sell, distribute or facilitate:

• firearms;
• ammunition;
• illegal weapons;
• explosives;
• prohibited weapon components;
• weapons intended for unlawful violence; or
• other prohibited dangerous goods.

11.2 Users must not create a Goal whose purpose is to finance the acquisition, production or distribution of prohibited weapons or dangerous goods.

12.1 Users must not use Wishew to fund, purchase, manufacture, sell, distribute or facilitate:

• illegal drugs;
• unlawfully supplied controlled substances;
• drug trafficking;
• substances intended to imitate illegal drugs;
• equipment primarily intended for illegal drug manufacture or consumption; or
• other unlawful drug-related activity.

12.2 Users must not disguise prohibited drug-related activity as a personal Goal or Support Payment.

13.1 Users may not activate the Funds Function for Goals whose primary purpose is to raise funds for:

• medical treatment;
• surgical procedures;
• prescription medicines;
• healthcare expenses;
• emergency medical expenses;
• experimental medical treatment; or
• life-saving medical intervention.

13.2 Wishew does not verify medical diagnoses, treatment claims or medical necessity and must not be used as a medical fundraising platform.

13.3 This restriction relates to the Funds Function and does not, by itself, prohibit lawful Content concerning a User's health, wellbeing or personal experiences where otherwise permitted under the Terms.

14.1 Users may not activate the Funds Function for Goals whose primary purpose is related to:

• wars;
• armed conflicts;
• military operations;
• financing armed groups;
• weapons or military equipment;
• natural-disaster relief;
• humanitarian emergencies;
• emergency relief funds; or
• fundraising on behalf of organisations involved in armed conflict.

14.2 This restriction applies to the use of the Funds Function and does not, by itself, prohibit lawful discussion of current events through ordinary social functionality.

14.3 Wishew may restrict Content or Accounts independently where such activity violates other provisions of this AUP, including those concerning terrorism, violent extremism, sanctions or unlawful violence.

15.1 Unless expressly approved by Wishew, Users must not use the Funds Function to:

• raise funds on behalf of a charity or nonprofit organisation;
• represent themselves as collecting donations for a charitable organisation;
• collect Support Payments for an unrelated third-party beneficiary;
• act as an intermediary for donations; or
• solicit charitable donations using an organisation's identity without authorisation.

15.2 Users must not falsely claim that:

• Wishew has endorsed a Goal;
• Wishew has verified or endorsed a charitable organisation;
• a Goal is associated with a charity where it is not; or
• Support Payments are tax deductible.

15.3 Nothing in this Section prevents Wishew from introducing authorised charitable functionality in the future subject to appropriate verification, controls and additional terms.

16.1 The Funds Function must not be used primarily to:

• repay personal loans;
• repay credit-card debt;
• satisfy bankruptcy obligations;
• pay criminal fines or financial penalties;
• repay money owed to another person; or
• facilitate debt collection.

16.2 This restriction does not prevent Users from creating ordinary personal Goals involving purchases, experiences, education, projects or other permitted purposes.

17.1 Users must not:

• create fake or materially misleading Goals;
• misrepresent the intended purpose of Support Payments;
• misrepresent the intended beneficiary;
• impersonate another person;
• use stolen, fabricated or false identity information;
• submit falsified verification documents;
• create fictitious emergencies or circumstances;
• manipulate Reputation Points;
• artificially inflate Goal engagement;
• collude with other Users to circumvent Platform controls;
• make sham, reciprocal or circular Support Payments;
• create or use multiple Accounts to circumvent restrictions;
• structure or split transactions to avoid limits;
• engage in card testing;
• use stolen or unauthorised payment credentials;
• abuse refund or chargeback procedures; or
• otherwise manipulate Wishew's systems, payment functionality or risk controls.

17.2 Users must reasonably cooperate with fraud, compliance, transaction or Account reviews conducted by Wishew.

18.1 Users must not publish Content or create Goals that unlawfully:

• infringe copyright;
• infringe trademarks;
• misuse another person's image or likeness;
• disclose confidential information;
• violate privacy or data-protection rights; or
• otherwise infringe the legal rights of another person or organisation.

19.1 Users must not:

• attempt unauthorised access to Wishew systems or Accounts;
• interfere with Platform security;
• introduce malware, ransomware or malicious code;
• scrape or harvest Platform data without authorisation;
• conduct unauthorised vulnerability or penetration testing;
• circumvent technical or Platform restrictions;
• manipulate payment functionality;
• interfere with fraud-prevention or transaction-monitoring systems;
• attempt to bypass identity verification; or
• use automated systems in a manner prohibited by Wishew.

20.1 Users must not attempt to circumvent this AUP, the Terms or Wishew's controls by:

• intentionally misclassifying a Goal;
• providing false or incomplete information;
• splitting or structuring transactions to avoid limits;
• using multiple Accounts;
• routing Support Payments through another User;
• concealing the true beneficiary of Support Payments;
• disguising prohibited transactions as permitted Support Payments;
• moving prohibited activity off-platform after using Wishew to solicit Support Payments; or
• using another person or entity to perform an activity the User could not perform directly.

20.2 An activity remains prohibited where its substance falls within this AUP regardless of how it is described, labelled or structured.

21.1 Access to the Funds Function, Support Payments and withdrawals may be subject to additional legal, compliance, identity-verification, fraud-prevention and risk requirements.

21.2 Wishew may impose additional or more restrictive requirements on particular Users, Goals, jurisdictions, transactions, payment methods or categories of activity, where reasonably necessary for legal or regulatory compliance, fraud prevention, financial-crime prevention, Platform safety or continued provision of payment functionality.

21.3 Wishew may require additional information, documentation, identity verification or re-verification before permitting or continuing access to the Funds Function, Support Payments or withdrawals.

21.4 Approval of an Account or Goal by Wishew does not guarantee that a particular Support Payment, withdrawal or payment method will be available, accepted or completed.

22.1 Wishew may use automated systems, manual review and information provided by third parties to identify potential violations of this AUP, fraud, financial crime or other Platform risks.

22.2 Where Wishew reasonably suspects or identifies a violation, it may:

• request additional information or documentation;
• require identity verification or re-verification;
• review a Goal, Account or transaction;
• issue a warning;
• remove or restrict Content;
• remove or adjust Reputation Points;
• disable the Funds Function;
• decline or restrict Support Payments;
• delay or restrict withdrawals;
• impose transaction or Account limits;
• suspend an Account;
• terminate an Account;
• refund or reverse transactions where appropriate; or
• report activity to competent authorities where required or permitted by law.

22.3 Wishew may take reasonable preventative action while an investigation, fraud review or compliance review is ongoing.

22.4 Wishew may take action even where activity is not expressly listed in this AUP if Wishew reasonably determines that the activity is unlawful, fraudulent, deceptive, harmful, presents an unacceptable financial-crime or Platform risk, or is materially inconsistent with the intended use of Wishew.

23.1 Users may report suspected violations of this AUP to compliance@wishew.com.

23.2 Wishew may request supporting information where reasonably necessary to investigate a report.

24.1 Wishew may update this AUP from time to time to reflect:

• changes to the Platform;
• changes in applicable law or regulation;
• fraud or financial-crime risks;
• changes to payment or compliance requirements; or
• changes to Wishew's risk controls.

24.2 Updated versions will become effective upon publication or on such later date as Wishew specifies, subject to applicable law.
